Alan Dershowitz Confronts Hannity on Abortion Ruling's 'Judicial Activism'

Dobbs v. Jackson, the case the Court ruled on that led to the overturning of Roe, involved the constitutionality of a Mississippi law banning abortion after a woman is 15 weeks pregnant—not a law that completely banned the procedure, Dershowitz explained.

The attorney argued that the Court overstepped its boundaries by completely overturning Roe v. Wade because the specific case dealt with only the 15 week ban.

"I do think the Supreme Court should never have had to reach beyond the 15 weeks," Dershowitz said. "That's what was before the Supreme Court."

He said the Court should have waited "until a case comes before the Supreme Court in which a state says, 'no abortions,' and then the Supreme Court could have overruled Roe v. Wade" and that it was "unnecessary to do it now." He confronted Hannity, who, like other conservatives, has remained opposed to judicial activism on other cases, about why he supports the Court's decision

Once the door was opened by the Dobbs v. Jackson court had to look into the rationale for the Constitution blocking the Mississippi case They found there was no rationale for the Constitution to block the Mississippi case at all. Hence the bringing of the Dobbs v. Jackson case caused the overturning of Roe v Wade.

First the Alt-Right installed activist judges then those justices started cherry-picking their cases. Congratulations; Trump corrupted SCOTUS. Now their reputation has been shattered by their own failure to be impartial. Sad, but clearly a sign of the times.

While I doubt the impact will be felt much by November, I'm confident the consequences will be felt by November 2024.

It's pays to have corrupt Justices stacking SCOTUS. More oath-breakers just like you, ExLa.

People will see the connection on who gets elected and the effect it can have for years after

Midterms are typically local in nature. People just vote for the R or the D.

The key, IMO, is to get more eligible voters to vote. In 2018 there was only a 50% turnout. In 2014, about 37%.

Presidential elections have higher turnout, but, like 2016, typically about 60%. The 2020 election was a remarkable 66%, above even the excellent turnout in 2008.

More women than ever will vote this election

The republicans are the dog that caught the bus
They will be voting for cheap food, $2 gasoline, low crime, low inflation and plentiful baby formula. They tried the Democrats but they proved themselves incapable of running the country.

Dershowitz is a douche. He has no morals.

exactly.
if they are looking at the 15 weeks Ms. cutoff, there is no reason not to look at the entire law it's based on
Roberts always wants incrementalism, but the foundation was decayed
