Affirmative Action Ruling Is Interestingly Qualified

After kicking the law into the rubbish, Roberts adds this morsel:

“At the same time, as all parties agree, nothing in this opinion should be construed as prohibiting universities from considering an applicant’s discussion of how race affected his or her life, be it through discrimination, inspiration, or otherwise.”

We have yet to see how this will play out but it certainly made it easier for people to challenge affirmative action now.

After a few lawsuits I imagine that universities will start phasing out this practice so while the ruling does allow some consideration of race still, they are limited in their scope in which to apply it.

The Court kind of left this open to let lower courts determine the specifics of the ruling.

Can be fun to imagine. I do it myself.

It won't be easy to get a court to overturn an individual admission made on the basis of a higher SAT score vs. the range of a targeted applicant's personal qualifications.
