Previous to that the "emergencies" were less well defined and far more open ended. In this case Congressional review of this emergency would make this bid fail. Therefore it is my prediction that the President won't even try. Specifically this president as he wants his image to appear strong.
I suspect he was aware the bid would fail from the beginning and is just building a way for his supporters to blame those opposed to the wall.

26/44 would be a majority of democrat senators would it not? I mean 59% of senate democrats voted for a fence. Why is a fence better than a wall to keep people out?
