I guess you don't understand legal terms. When a person is indicted it stops the statute of limitations on the crime and all evidence is valid. Is that simple enough for you. All evidence of Sussman's guilt is available for Durham to use. The statute of limitations does not apply.

The text message can't be charged as a crime because the statute of limitations has expired since the text message was more than 5 years ago and Durham didn't discover the text until after the statute of limitations had expired. The text message is not evidence of what was said at the meeting since it was sent the day before. The text message is only evidence of a state of mind. It isn't proof that the charged lie was told at the meeting.

There can be no indictment for the text so there can be no toll for that since the time period has already expired.

The only evidence that Durham can use is what the court says he can use that was provided to the defense in a timely fashion. In this case, Durham failed to provide several things to the defense as required by law so the court says he can't use it. The court has also said that Durham's team can't bring speculative bullshit into the courtroom. Of course that hasn't stopped them from doing that.
