seems that if the feds want something, then they have to either have a regulatory agency declare something or pass an amendment

In one reading of that statement you are essentially saying that the federal government has no power. In the other you are saying that it has no power but most go through the strenuous and horrendous trial of passing it through a regulatory agency. The tenth amendment doesn't mention regulatory agencies, but whatever.

if you read the link you will discover that the supremes have effectively gutted the 10th amendment...:(

The 14th Amendment took away a bunch of state's rights. However it doesn't change what the Feds have power over, that is listed. If it isn't on that list, the Feds are not supposed to muck with it.

the key phrase is 'not supposed to muck' but the feds seem to find ways to do so even without an amendment...with the scotus' help

they got religion and lost sight of what made them strong with a lot of people

back when the reps advocated fiscal responsibility and state and personal rights, i was a rep

but then rr got in and voodoo economics and it was all down hill from there

they got in big business' pocket and then the religious right moved in

actually big business learned and has congress critters from both parties in their pockets so they do not need the reps as much as they used to

i should include big labor but labor is not as big as it used to be

oh blast, here i go again...:(
 
the 14th Amendment was written and ratified with the greatest of intentions, providing protection for all rights in any state that the person was in, however, a total abuse of power by the USSC at that time effectively put the determination of all rights in the hands of a judiciary body and severely limited the effectiveness of congress.
