US citizen gunned down by American Government in Yemen

I didn't say I wasn't O.K> with him being killed. I just want to make sure it was done legaly.
As far as I remember, Gerald Ford decreed that America wouldn't assassinate anyone. Now we kill our own citizens without trial.
Is a sham trial too much to ask?
One would assume of course, that there would be an actual judge present.

as to killing our own citizens, this is an interesting and serious topic. what if someone in colorado who is known by the alias "damocles", foments a so called private war against the US. he recruits fanatical spazzes like superfreak. under damocles brilliant and charismatic leadership, he instructs his followers to set off nuclear bombs, or whatnot, inside the US.

what should our course of action be?
 
So, we went through this process to attack the British at Lexington, the Mexicans at Veracruz, the Confederates at Antietam, the Spanish at San Juan Hill, the Germans at Metz, the Japanese at Midway, the North Koreans at Inchon Harbor, the North Vietnamese during Tet, etc.?

Our courts don't run wars. That's what the President and the DoD are for.

We are not in a fucking war in Yemen.
 
Its not as if these are US citizens who are vacationing out of the country. The man was an expatriate, actively living abroad, engaged in high-level terrorist activities, and commanding a station of leadership within al-Queda.

And still entitled to due process.
 
I have had major reservations about drone attacks since I first heard of them.
Especialy when a drone takes out a large amount of people.
As for Bin Laden per se, I am sure his captors could/would make a case for self defense, in terms of his death, though surely (IMHO) he should have been captured, tried, then executed. I am generaly against the death penalty but in his case willing to make an exception.

yet, you are unsure about this guy? i don't understand the dichotomy.

what is it about drones that you don't like? would you rather we risk more lives and use B52s? put men on the street? warbirds with actual people in the machine flying?

Damo must be punished, AFTER he is caught, tried and sentenced. If many law enforcement agents die in the process, that is just the price of freedom.
 
Until you can show me where the Constitution shows that the power to conduct our wars is actually in Article III, rather than Article II, you're barking up the wrong tree.

by conduct, do you mean "declare"? what do you mean by conduct? article II doesn't talk about war powers.

and if taking him out significantly or completely eliminates the risk to the nation, you still aren't down for that?

Does the lack of a Congressional declaration in the past excuse the government from respecting Constitutional rights today?
