Article 134—Disloyal statements

See Paragraph 60.

Elements.

(1) That the accused made a certain statement;

(2) That the statement was communicated to another person;

(3) That the statement was disloyal to the United States;

(4) That the statement was made with the intent to promote disloyalty or disaffection toward the United States by any member of the armed forces or to interfere with or impair the loyalty to the United States or good order and discipline of any member of the armed forces; and

(5) That, under the circumstances, the conduct of the accused was to the prejudice of good order and discipline in the armed forces or was of a nature to bring discredit upon the armed forces.
Yeah they try to pin 134 on everyone if they have nothing else, generally citing it as a "general article" meaning they can make up whatever they want. They're wrong of course, since 134 is composed of several specifics charges. I challenged my command on it once and won that way.
 
I wonder what Solantic Scott is signing on this woman's back. Or is he getting an involuntary blood sample to test her for drugs?

I didn't say you gave up your constitutional rights. I said you gave up certain constitutional freedoms. As for when you're not operating weapons? That's an irrelevant point as there is an expectation that as some point you may be required to and that there is a significant safety concern if you are under the influence of drugs. It's the same in virtually all safety related position. A truck driver with class A CDL isn't always driving a truck 24-7 either but is expected to be drug free when he/she does.

All services would be privatized, and because businesses are inherently more trustworthy than government, the invisible hand of the free market would insure the safety of all consumers.

I touched bleach and pens about 1000x more than I touched guns, and I was a machine gunner in iraq. Its a non concern unless deployed, where they're not allowed (or able) to drug test.
