EmailPrintHOUSTON -- A 7-year-old boy accidentally shot and killed his 5-year-old brother at a west Houston motel on Tuesday, according to police.

Houston police said the shooting happened in Room 138 at the Motel 6 on the Katy Freeway near state Highway 6 about 10:30 a.m.
"Right now, it's just two children involved with a gun," said Sgt. Bobby Roberts with the Houston Police Department. "His 7-year-old brother got a gun from somewhere and shot him."
The 5-year-old was shot once in the chest with a rifle. Roberts said it appeared to be an accident.
The father was out of the room at the time, paying his bill, police said. The father was gone for only a few minutes, according to authorities.
"The dad came back and was holding the child, so everyone saw him with the child outside," Roberts said. "I haven't talked to the child. He's a young child. I'm going to have him interviewed by a psychologist as opposed to me talking to him. He just has his head down, and I'm sure he's pretty distraught, as well. I just let him sit with his dad right now. The dad is really shook up."
Police said it will be up to the District Attorney's Office as to whether any charges will be filed, including allowing a minor access to a firearm.
Investigators said the boys and their father had lived at the motel for about a year and a half and that the family was from California.
The children's mother does not live with the family, officials said.
Detectives have not said where the 7-year-old got the weapon.
The foster care case of the 7-year-old will go before a family court judge Wednesday morning. Child Protective Services said the 7-year-old is now with a foster family.
