good point. given the president's war powers, do you believe this military action is unconstitutional?

I believe a declaration of war is different then the humanitarian effort that is behind a/this "no fly zone"...I am certainly open to correction if it can be provided.
 
Launching cruise missiles is an act of war.

Article 1, Sec. 8 states that only Congress has the authority to declare war.

50 U.S.C. 1541-1548 states that the president may undertake the use of military force if "a national emergency created by attack upon the United States, its territories or possessions, or its armed forces."

It also says that the President MUST consult with Congress.

"in every possible instance shall consult with Congress before introducing United States Armed Forces into hostilities"
 
The news is reporting that Qaddafi compound has been bombed....is that attempted assassination of the leader of sovereign nation by the United Nations ?

Makes you wonder why there is no 'humanitarian effort' in the Sudan where a million civilians have been killed, raped, robbed and beaten for fun....

I just read that in light of the "War Powers Act" WPA- that a formal consent "Joint Resolution of Congress" can be used for temporary measures? Again does anyone know what and how it ws handled for Iraq and Bosnia during Clinton's presidency?

Yes, as a mater of fact, it does...and I have thought about it. We all have to agree that it is oil. I am unapologetic for that fact-but I am disgusted by our politicians disingenuos pandering about humanitarianism (though I personally think it is humane to help anti Ghadafi rebels). I am especially disgusted that we conservatives are not saying we need to protect oil interests in an open and honest way clarifying the economic need to do so. And for you folks who think we should get off ME oil then let us fucking drill here and drill NOW!
 
The War Powers Resolution of 1973 (50 U.S.C. 1541–1548) was a United States Congress joint resolution providing that the President can send U.S. armed forces into action abroad only by authorization of Congress or if the United States is already under attack or serious threat. The War Powers Resolution requires the president to notify Congress within 48 hours of committing armed forces to military action and forbids armed forces from remaining for more than 60 days, with a further 30 day withdrawal period, without an authorization of the use of military force or a declaration of war.

I was asking with the wrong question-or are you? The point in question is not the duration of the NFZ but the initial commitment. Clintons violation was in exceeding the 60 day limitation imposed by the WPA.

Apparently the initial commitment was legal?

Title 50 of the US Code is pretty damn clear unless you're trying to spin its meaning and intent for some personal/political reason....

We were not in imminent danger from being attacked by Libya ....
Personally, I believe Obama should have consulted with Congress and gotten some kind of approval for committing our troops to warfare with another sovereign nation.....
We don't take orders from the UN....
