the analogy isn't perfect, but i don't see where the federal government can force you to buy a product, even if you don't use it. i think h/c should be a state issue, like auto insurance. the federal government forced merchant mariners to buy h/c, but they also chose to work in that profession. and maritime laws are under federal jurisdiction. so using that analogy falls flat

Dune the point is is that Yurt thinks the federal mandate on H.C. insurance is unconstitutional. Which it is.
I agree somewhat with Yurt about leaving it up to the states. If your particular state mandates businesses purchase it for employees I wouldn't be as upset by it. The cost of such things would still be offset by product or service price increases across the board though.

The reason is for liability insurance. Do they make you insure your own car? Nope! If you own the car, all you need is liability insurance.
Right there is the distinction. It's to protect others from your mistakes.

mott....insurance is a product...you're not paying them to clean your windows, you're giving them money to protect you against losses, in essence, you're paying them money in order that they give you money in return (or indemnify you).

You are the one who refuses to clearly state your position.
The federal government does not register cars, why would they force you to buy insurance? Here in Mass, liability is a requirement for registration.
There is no corelation between this and health insurance.

my OP was not a position, it was a question. amazing you don't know the difference. the federal government could require you to have auto insurance because you car could cross state lines, thus bringing in the commerce clause. thats the whole point. that is what the government is using to force you to buy insurance.
the correlation is simple, can a federal government force you to purchase insurance, like a state can force you to purchase auto insurance, even if you do not own a car? my point is, that states can do this, because you don't have to use a car. there of course is the argument that having a car today is essential to survive, but that is a separate argument.
so if the government can't force you to buy auto insurance, what gives them the constitutional power to force you to buy health insurance?
