Prop 13 was passed by the voters of the state of California. Thanks to the iniative process in the state it is as close to direct democracy as we can get which I thought Desh was a big fan of. California voters have also voted where 74% of the state budget must be directed. The Governor and Legislature only control 26% of spending.

Does that mean a bad law should not be changed because it was voted in by 2/3rds of the people 30+ years ago?
You have a situation in Cali where someone who was given their house by their parents is paying 1976 taxes on their house while the young couple next door are paying 2008 taxes on the same value house.

The problem was they didn't include a balanced budget portion that required the government to live within their means. And it was property taxes that went down, not all taxes. They increase sales taxes and almost completely replaced the lost revenue from the property taxes. At the same time the law does what it was designed to do, let people keep homes that they otherwise could not afford because of automatic property tax increases that were getting out of hand. The problem isn't prop 13, the problem is adding government programs without adding a way to pay for them, then borrowing the money to pay for them rather than working within their means.
