Virginia health care lawsuit can proceed, judge rules

Washington (CNN) – The Commonwealth of Virginia will be allowed to continue its constitutional challenge to the health care bill signed into law by President Obama earlier this year, a federal trial court ruled Monday.

Judge Henry Hudson ruled in a 32-page opinion that the legal challenge mounted by Virginia State Attorney General Ken Cuccinelli should be allowed to continue. The state argues that part of the health care bill – Section 1501, which requires individuals to obtain a minimum level of health insurance – is unconstitutional.

"While this case raises a host of complex constitutional issues, all seem to distill to the single question of whether or not Congress has the power to regulate - and tax - a citizen's decision not to participate in interstate commerce," Hudson wrote in his opinion. "Neither the U.S. Supreme Court nor any circuit court of appeals has squarely addressed this issue."

Cuccinelli voiced his approval of the judge's ruling in a statement issued after the court ruled.

"We are pleased that Judge Hudson agreed that Virginia has the standing to move forward with our suit and that our complaint alleged a valid claim." Cuccinelli said.

I wouldn't get too excited just yet. The case didn't get thrown out but it's a far far far cry away from being successful. I'll be interested to see what the Florida court does.

I can't see how this healthcare law is going to help me personally. At all as a matter of fact.

If it were a new car, I wouldn't buy it. The contract is less than acceptable. We could do a lot better.

We could do a lot better by getting government the fuck out of it, and stop this idiotic thinking that government can provide solutions to all our problems. Liberals whined and moaned and complained until they finally got enough idiots elected to pass Nationalized Health Care, and what do we have to show for it? A multi-trillion-dollar clusterfuck that will do the exact opposite of what they all claimed to want! Even if Republicans do manage to repeal it, our kids and grandkids will still be paying for it's short-lived existence.

Nope, I live in Alabama.

What I said is still true. Before Democrats were in charge, we had more affordable health care, more available health care, and better quality health care. The HCR they passed, diminishes all three of these areas considerably, when it all takes effect. That is just a fact of the matter. This is why about 58% of the country wants to see it repealed.

Health care had not been affordable in this country for a long time and it had nothing to do with the Democrats! and everything to do with medicine for profit!

Well guess what, the Chief Actuary of Medicaid says the HCR bill will INCREASE costs. So, regardless of who was responsible for health care costs being high, and regardless of the fact they were high and unaffordable for some, thanks to Democrats, it's going to be WORSE.

Big whoop. Judges also let Obama birther challenges from Orly Taitz and Philip Berg continue, and where did that get them. Not a single action decided in their favor.
