SB 1070 specifically contains language requiring law enforcement to determine the immigation status of anyone they encounter when they have "reasonable suspicion" that person may be illegal.

This constitutes unreasonable search and seizure and violates the equal protections guaranteed under the United States Constitution.

So the AZ law is requiring all hispanics to stop by the police station to be interrogated and fingerprinted?
No but it would be requiring a US citizen to prove his citizenship status cause he/she looks hispanic. The law may not state so but that is the sum affect. I question the constitutionality of that.

What about the constitutionality of a federal government that refuses to protect it;s citizenry against invasion? i'd say the legitimacy of that government has failed, taking the constitution with it.

Mostly it would be behavior based, I would imagine. Not necessarily racial in nature.

But first, as the law clearly states, there would have to be "Lawful Contact". So its not just "police running around asking brown people for their papers".

You're not being realistic here Winter. Do you really think that this law will equally target white people and challenge them to verify their citizenship status? If you do believe that then your belief that this law is not racist is understandable. Naive as hell but understandable.

Let me give you a what if scenario. My state borders Canada. What if we had large numbers of Canadians illegally immigrating here? Now suppose the State of Ohio passes a law similiar to AZ's and assume that white people are a minority in Ohio. Now how should I feel about being trageted and having to prove my citizenship status upon the demand of a police officer who has some poorly defined reasonable cause? Should I not feel singled out as a minority citizen? Should I not feel that is unfair? Should I not feel that is discriminatory and therefore racist?
 
It IS an excellent question. But more to the point, does the law state anywhere in it that race is to be used as a basis for that reasonable suspicion?
No it does not but neither did many of the poll taxes or literacy tests in the south during the Jim Crow era, do you deny the racism implicit in those laws?

Your example shows the policemnan to be racist, but not the law itself.

I do not believe this law is racist. I believe its bullshit mainly because of it requiring US citizens to carry their "papers" to prove they are citizens.

It requires that someone prove they are innocent.

No one listens? Millions of people disagree with you.

Police profile Latinos every day. Just as they profile African-Americans. Racism is real.

A Hispanic is more than twice as likely to be stopped by police in Arizona according to the latest (2009) data available from Arizona Department of Public safety.

We will continue to cry 'Racism', not 'wolf' when racial profiling is used.
