Justice Department "MISCONDUCT" in Comey Case

WASHINGTON (AP) — The Justice Department engaged in a “disturbing pattern of profound investigative missteps” when it secured an indictment against former FBI Director James Comey, a federal judge ruled Monday in directing prosecutors to produce to defense lawyers all grand jury materials from the case.

Those problems, wrote Magistrate Judge William Fitzpatrick, include “fundamental misstatements of the law” by a prosecutor to a grand jury that indicted Comey in September, the use of potentially privileged communications in the investigation and unexplained irregularities in the transcript of the grand jury proceedings.

The 24-page opinion is the most blistering assessment yet by a judge of a criminal case against Comey that is already subject to multiple other challenges, including motions seeking its dismissal on the grounds that the interim U.S. attorney who filed the charges, Lindsey Halligan, was illegally appointed and that the prosecution itself constitutes a vindictive prosecution.

The judge said that when Ms. Halligan appeared — by herself — in front of the grand jury, she made at least two “fundamental and highly prejudicial” misstatements of the law. He also pointed out that the grand jury materials he ordered Ms. Halligan to turn over to him for his review appeared to be incomplete and “likely do not reflect the full proceedings.”

“The court is finding that the government’s actions in this case — whether purposeful, reckless or negligent — raise genuine issues of misconduct, are inextricably linked to the government’s grand jury presentation and deserve to be fully explored by the defense,” Judge Fitzpatrick wrote.

 
The ones Trump put in power will likely face bar charges. The incompetence of this administration is monumental. He put people in charge who will blindly follow his orders. He did not install them based on talent and experience. So his clown show strikes again.

Judge Says Justice Dept. May Have Committed Misconduct in Comey Case​


A federal magistrate judge said on Monday that the criminal case against James B. Comey, the former F.B.I. director, could be in trouble because of a series of apparent errors committed in front of the grand jury by Lindsey Halligan, the inexperienced prosecutor picked by President Trump to oversee the matter.

@T. A. Gardner is arguing none of this really matters as the DoJ has a historical 90+% conviction record and people often plead out to some lesser charges because of that.

When i tell Terry that was based on intelligent DoJ people and not the Magats Trump put in power, who are stupid, who are also failing to get indictments at record paces and seeing ham sandwiches laugh at them, Terry is such a magat and also so dumb that he stands by a belief James and Comey will plead out. :rofl2:

You got that wrong, as it is not that hard to get indictments and/or convictions of the shit stains, as long as you go after the guilty...

You might want to actually read the judge's ruling since you claim you hate the swamp. the judge cites 11 different findings where mistakes were made during grand jury proceedings. It isn't that long and is a fairly easy read.


This may be the biggest issue that if you actually hate the swamp you would be up in arms over instead of trying to support the swamp. Claiming that they can indict without evidence because the evidence will be presented later is one of the worst swamp things ever.

That is only one of the 11 findings. The fact that 11 errors were made is pretty astounding, don't you think?
