In civil law, that is the case. You have to have a party that suffered a loss to get awarded a settlement. No loss, no settlement. The NY appeals court has said as much by tossing out the settlement against Trump entirely.

The best you have ever admitted when you are not hand waving the FACT that Oil and Gas has been one of the most subsidized industries in all of America's history is that you call the subsidies, if any, small, while you pretend Solar and Wind and green energy are some type of outsized outlier getting way more than Oil and Gas do or ever did.

You also never consider the 100+ years of embedded subsidies that Oil and Gas received, meaning they still hold that value gained from tax payers subsidies to compete against Green energy today.
