Immigration judge denies Kilmar Abrego Garcia's bid to reopen immigration case

Washington — An immigration judge in Maryland declined to reopen the immigration case involving Kilmar Abrego Garcia, the Salvadoran man who was mistakenly deported to his home country earlier this year and then brought back to the U.S. to face criminal charges, according to court filings.
Abrego Garcia's lawyers had asked an immigration judge in August to reopen the proceedings and allow him to seek asylum in the United States. While the bid was denied, Abrego Garcia can appeal the decision to the Board of Immigration Appeals.
In a court filing in one of Abrego Garcia's cases in Maryland, his lawyers said that immigration judge Philip Taylor determined that there is "insufficient evidence that the Department of Homeland Security 'has presented [Abrego Garcia] with a formal notice of removal or any other document showing its intent to remove him to Uganda, Eswatini, or any other third country.'"
Taylor wrote in a separate decision that there is "insufficient evidence" to demonstrate that Abrego Garcia's removal to Uganda, El Salvador or another country is "imminent."
The Department of Homeland Security said Abrego Garcia's final order of removal stands.
