They can testify and the judge can take their testimony into consideration when imposing the sentence.

State should have picked up the assault charge...the state can pick up an assault charge because assault is a crime against society, not just the victim...The decision to prosecute lies with the prosecutor or district attorney, who decides whether to pursue the case, even if the victim doesn't want to press charges or wants to drop them!

His sentence was for six years, if he served his full sentence he would have been released in 2021.
