But the judge who presided over his 2019 case said that based on the confidential information, there was sufficient evidence to support Mr Abrego Garcia's gang membership. That finding was later upheld by another judge.

Well, the most spoken language there is English.... but still. Uganda, man. Geebus. It has got to be a violation of the 8th. I mean, if you don't have a screen to keep showers private in jails that is a violation of the 8th. Sending them to a different continent than the one they came from? I just cannot see how that isn't a violation of the 8th.

The funny thing is, no such thing ever happened. What you linked to is not any ruling by any judge that he was a member of MS-13. The only judge's ruling is that he should be released without bond since he wasn't a flight risk.

I don’t think it’s a violation unless it is punishment. The government is prohibited against inflicting cruel and unusual PUNISHMENT. I’m not up on the caseload.

So u POS call Trump a rapist because a ""civil judge"" said he was....but u wont call this guy a MS-13 member after a judge ruled there was evidence that he was and the appeals court affirmed that ruling!

Hmm... I think we spend too much time splitting the hair here. I think a civil fine that includes deportation to an entirely new continent is punitive in nature. If this isn't an act of government putting the cost of civil violations too high and thus violating the 8th I cannot see how any fine could be considered a violation.

If they chose Uganda because it’s bad for the deportee, I’d call that punishment. If they chose it because it’s the most convenient, it’s not punishment.
