I love how they went from "Maryland Dad" to, "we just wanted him to face charges"... While I do see a few who actually just wanted a hearing of some type before he was deported (and the SCOTUS ruled that there must be hearings, but only to prove they are part of the "invading enemy"), there were way more of them telling us he was "not MS-13" that "tattoos aren't enough to prove that" and other nonsense, expecting him to come back and be released who are now realizing that this probably wasn't the innocent "Maryland Dad" to hang their hopes and hats on...

Interestingly, around 200 went with him, this is the only one that apparently needed this hearing for "due process" the rest didn't seem to hit their radar, it was the "Maryland Dad" that needed their tender care.

Who cares? I know nothing of this guy, and if he is found guilty in a legal proceeding he needs to face the consequences.

Actually, conspiracy charges are hard to beat. All that's needed by the prosecution is to show a solid link between the conspirators and after that, the defendant is pretty much fucked.


The claim in the indictment is no indication of what will be actually presented at trial beyond an outline. You are focused on something that is a minor detail here.

I say Garcia is fucked. The feds will nail him and he's going to prison for a decade or more.
When the prosecution is lying about facts, it's hardly a minor detail. It raises questions in the jury's mind about what else the government is lying about. It raises questions in the judge's mind about the veracity of the indictment. Making false statements to the GJ may come with it's own criminal liability.

Garcia may well be convicted. But the sloppy work of the AG may end up meaning he won't be convicted. At this point she is trying hard to get him off on one technicality or another.

At this point Bondi appears to have violated the sections on Concerns for Media Contacts and the Concerns of Prejudice. Those violations allow for a defendant to credibly claim they can't get a fair trial.
