Trump Freaks After SCOTUS Trashes His Birthright Citizenship Arguments​

Supreme Court justices on both sides of the ideological spectrum dismantled the Trump administration’s birthright citizenship arguments, so the president, in turn, accused the nation’s highest judiciary of being gamed by his political opponents.

“The Radical Left SleazeBags, which has no cards remaining in its illegal bag of tricks, is, in a very coordinated manner, PLAYING THE REF with regard to the United States Supreme Court,” Donald Trump posted on Truth Social around midnight Thursday. “They lost the Election in a landslide, and with it, have totally lost their confidence and reason. They are stone cold CRAZY! I hope the Supreme Court doesn’t fall for the games they play. The people are with us in bigger numbers than ever before. They want to, MAKE AMERICA GREAT AGAIN!!!”

Birthright citizenship is baked into the Fourteenth Amendment, which guarantees citizenship to everyone born or naturalized on U.S. soil. But Trump attempted to end the constitutionally enshrined right mere hours after he was sworn in by signing an executive order stating that children born to immigrants on temporary visas or who are in the country illegally should not be entitled to birthright status. Trump’s order has since been blocked by multiple judges in multiple court circuits.

The Justice Department’s case was an effort by the administration to curb their lower court rulings, hoping to stymy their losses on birthright cases by winning a ruling that judges can only block orders related specifically to the people or areas involved.

The president was apparently still ruminating on it by Friday morning, when he posted on Truth Social that the “SUPREME COURT IS BEING PLAYED BY THE RADICAL LEFT LOSERS, WHO HAVE NO SUPPORT, THE PUBLIC HATES THEM, AND THEIR ONLY HOPE IS THE INTIMIDATION OF THE COURT, ITSELF. WE CAN’T LET THAT HAPPEN TO OUR COUNTRY!”

But both conservative and liberal justices torched the Trump administration’s arguments for ending the program during a Supreme Court hearing Thursday. Justice Elena Kagan questioned why the White House was blatantly ignoring several lower court rulings that the executive order was unconstitutional. Justice Brett Kavanaugh—a Trump appointee—pressed the Justice Department’s lead lawyer into a corner, forcing U.S. Solicitor General D. John Sauer to admit that the Trump administration didn’t even know how it would actually enforce its birthright citizenship order.

The solicitor general also bewildered Justice Amy Coney Barrett—another Trump appointee—by arguing that Trump has the “right” to disregard legal opinions that he doesn’t personally agree with.

Trump et al., are making the wrong argument here.

We, as a nation should never reward criminal activity or those who flaunt or break our laws. That's the argument that should be made in this case, an it is a completely valid reason not to reward citizenship to a child born to a foreigner who did.
 
The US Constitution bans punishment of people based on the crimes of their parents. So you cannot remove citizenship from a baby no matter what crime the parents did.
The parents came here illegally to have their children. The parents who conducted a criminal act are being rewarded for that act. Their children who are US citizens, would be in the position to have one of two things happen:

1. They are deported along with their criminal parents to "keep the family together." When the child is 18 and no longer a ward of their criminal parents, they can return to the US as a citizen.

or

2. The parents are deported and the children go to foster care and eventually to a foster family to be raised in the US because they are US citizens. Their criminal parents go back to whatever country they're from and cannot return to the US.

Which would you prefer be the action taken? Anything that involves the criminal parents remaining in the US is to allow them to benefit from their crime(s).

Enough about the hopes, dreams, actions and decisions of the parents who aren't diplomats or hostile military occupiers; they don't factor into this issue.

Tell me about the child born in the US, and don't mention the parents or anyone who is not the child born in the US. What has the child done to warrant deprivation of his inalienable rights?

Get off the parents. Talk to me about the child born in the US and the crimes he has committed.

For those of you who are desperate for birthright citizenship to end, and for the children of illegal immigrants born in the US to be stripped of their inalienable right of US citizenship, I hope you are prepared for a splash of cold water. If you listened to the oral arguments presented in the case, they all but EVADED the birthright citizenship part of the issue. The Trump administration presented no arguments to end birthright citizenship. The entire focus was on the efficacy of the executive orders. Justice Sotomayor ventured into the area of birthright citizenship unopposed by equating the elimination of birthright citizenship with the government's arbitrary confiscation of all firearms. Technically, it is part of the case, but just as the SCOTUS can't countermand precedent or the 14th Amendment itself, SCOTUS cannot rule in favor of something that is not argued.

What I'm saying is that when the case is decided and all that is decided is some aspect of executive orders, nobody should be surprised in the least. Anyone who expects otherwise will be disappointed to the extent that he was expecting otherwise.

That went out the window when he pardoned the Jan 6 terrorist, and then paid Babbit's family $5 million.

The same way you handle a family of US citizens who are traveling to El Salvador. Imagine that family has a small child. Can that child get back into the US? Yep. Why? He's a US citizen. Make sure he has a passport be he leaves the country.

The child is not "on his own". He goes with the parents. The US government makes sure to register him as a US citizen so he can return as any other US citizen.

America needs birthright citizenship. It is the base of our country. People come here for opportunities and to raise families. They work and pay taxes. They start businesses at a faster rate than regular Americans.
The Founders figured it out. That is why they put it in an amendment. There is a procedure to change amendments. Trump ignores that and does what he wants and defies you to stop him.
