President Trump Issues a Warning to Joe Biden: “He Didn’t Give Himself a Pardon”

Let Trump and his minions try.

Just like we were told to let him try running in 24. Were were told he would either be in prison or under house arrest, or that he would be bled dry defending himself and wouldn't have the funds to run,....or that even if he did find a way to run another republican would surely take his place and win in a primary, or that because of legal actions against him he would be barred from taking office, or if all else failed,...there was NO WAY he could possibly defeat Kamala and the D's. The American people said " OH YEAH,....Hold my beer fuckheads,...w'ell see about that !" Left= proven WRONG quite BIGLY every step of the way just as they are wrong on this too. I am very much looking forward to the next 4 years. ;)

The collective left seems to have a learning disability. The proof is literally all around them, they are surrounded by it in fact,...it was also wrapped around the American peoples fist and jammed right down their throats on election day,.......yet they STILL cant see which way the wind is blowing. Their arrogance and willful ignorance is ASTOUNDING . If you actually look at the election data every state in the union ticked right,...every last one. Some moved right slightly,...some moved right a little more,...some moved BIG,..but they all moved RIGHT. YOU ARE REJECTED, Wake the F up dummies. We are seeing the death of the 60's far left hippy counter culture movement both as a political movement and quite literally as a demographic. Its OVER. The 1967 summer of love is now in late winter,...its dying and close to dead. We are now in the process of burying it. Get the shovels out,.......

Actually, a Presidential pardon is good against a military court martial.

Who told you that?

A Presidential pardon has broad powers under the U.S. Constitution, but there are nuances when it comes to military court martials:

  • Authority to Pardon: The President has the power under Article II, Section 2 of the Constitution to "grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment." This includes offenses under military law since military personnel are still under U.S. civilian authority.
  • Military vs. Civilian Jurisdiction: While a Presidential pardon can generally cover offenses committed under military law, the President does not have direct control over the military judicial process in the same way they do with civilian courts. However, a pardon can affect the outcome by nullifying the legal consequences of a conviction or by pre-empting a trial.
  • Application: If a pardon is issued before a court martial takes place, it could potentially prevent the trial from proceeding or negate the legal effects of any conviction. If issued after a court martial, it could mitigate or eliminate the punishment but does not erase the record of the court martial itself.
  • Limitations: A pardon does not cover state crimes, nor does it generally extend to reversing administrative or non-judicial punishments like reduction in rank or discharge from service, unless these are expressly included in the pardon's terms.
  • Practical Impact: Even with a pardon, the military might still conduct a court martial for reasons of discipline or to set an example, but the legal consequences (like imprisonment) would be nullified by the pardon.

Therefore, while a Presidential pardon can significantly influence or even prevent the legal consequences of a military court martial, it does not necessarily stop the military from holding the court martial itself. The exact impact would depend on the specifics of the pardon and the circumstances of the case.
