Every serviceman has the right, indeed the responsibility, to disobey unlawful orders.

That said, the birthers are a sad case of people not wanting to admit they lost they election.

They can be held pending a court martial to determine whether their orders are lawful or not.

That is, I think, his goal here. The only way the prosecution can proceed is to offer Obama's credentials as evidence.

While I think the whole 'birther' thing is nonsense, he has every right to question the lawfulness of orders. Obama could have put an end to this a long fucking time ago had he just supplied his birth certificate. Yes, it is ridiculous... but why the hell does he keep letting this go on? My guess is purely for political gain. He wants to create the impression there is something to hide so that the far right gets all lathered up and then eventually he will come out with it and say 'gee, what are you lunatics so worked up for?'. (just my opinion... I could be wrong)
