If Trump wanted a jury trial he was required to tick the box, letting the court know that was his wish. HE did not, thus he did not get it.
That the Judge might not have given it to him, because of NYS law, is something Trump could have then appealed.
if his rights were being violated it could be fixed by the higher courts.
But Trump has to begin that process by checking the box and not waiving it.
