Under 8 U.S.C. Sec. 1325, it is a crime for any noncitizen to enter (or even to "attempt" to enter) the United States anywhere other than a designated entry point, or "port of entry" or "POE." Therefore, in order for asylum seekers to avoid exposure to criminal prosecution for illegal entry to the United States, they must seek asylum at a port of entry along the border. While many asylum seekers follow the proper procedure by applying for asylum at a port of entry, many asylum seekers continue to illegally cross the border. When they are apprehended by Customs and Border Protection, there are two possibilities. First, they may be criminally charged with illegal entry (a misdemeanor) or illegal reentry (a felony) and, only after they finish their criminal cases, further detained by Immigration and Customs Enforcement (ICE) to await their credible or reasonable fear interviews. Second, they may not be prosecuted, and simply detained by ICE to await their interviews in an immigration detention center.

As I have posted 50 times, the moment that an illegal crosses anywhere than a legal port of entry, he/she has violated our immigration laws and is an illegal.

Swimming across the Rio Grande and crawling under razor wire is not applying at a legal port of entry.

I'd like to see what you have to post.

But make sure you do not forget to add to it, what the US Law requires if a person puts his foot on US Soil by any means (legal or illegal) and claims Asylum and refugee status.

That last part is important as it is very specific to what is going on now. So just a reminder not to forget. Oh and bold that bit for me please.

We AGREE the are 'illegal' if they enter the US from a place that is not Port of Entry.

But to be illegal that means they have ALREADY stepped foot on US soil.

WHAT HAPPENS TO ILLEGAL ASYLUM SEEKERS ONCE THEY HAVE BEEN ARRESTED?

This a big step for you Earl and you are close. They now have entry to the US illegally and have declared asylum. Explain what HAS to happen next by US law.
