This makes my day, democrats lost to a Republican in Massachusetts. Having President Clinton & Obama come and campaign for Coakley did not sway the voters.

Sen. Scott Brown soon to be driving his truck to Washington, running over the hopes and dreams of the democratic party.

Kirk is done by all intents and purposes. The "Teddy Kennedy's seat" is now back in the hands of the people to decide and decide they did. Finally the Kennedy stranglehold has lost it's grip!

It would depend on if they were appointed or elected. In this case the law is about an appointed temporary Senator who is no longer a Senator once a qualified person is elected. Since Coakley conceded, he is elected. Had Kirk been elected Mass. law does not render his position moot on the election of a qualified person to hold the office.

And quit crying. You are solely upset because your side lost a big one tonight and it is running out of excuses for the short coat tails of the President. I'll keep saying stuff that makes you angry because it is fun.

That isn't true, he is elected right now. That it isn't "certified" doesn't change reality. Of course, you and I agree that they won't do anything at all in the Senate.

An election is not complete until the ballots are counted, transmitted to the Secretary and certified. That cannot happen for at least 15 days. At this point, the results of the election are unofficial. Until they are official, he hasn't been elected.

And I note that you disregarded my observation on laws passed by Congress after an election but before a new Congress is sworn in. Are all laws passed in those intervening two months unconstitutional?

Tell that to Niki Tsongas. There is precedent in this state itself... pre-certification she and Brown were both elected.
