It happened around 11:30 pm near Lindbergh and McDonnell. Joseph Hibler was pulled over for an expired license plate on his way home from a funeral.

Hibler says the officer told him he had an open warrant. The warrant stemmed from a citation from 2018 over no vehicle insurance. He described what was going through his mind when the officer told him to get out of the car and handcuff him.

“My children are in the car. There’s no way they’re going to take me away from my children,” Hibler said

A bystander captured the traffic stop on camera. Hibler is heard saying it “isn’t even serious” as police hold him against the squad car and moments later tase him.

Meanwhile, the four kids, ages 14, 13, 11 and one year old, sit in the car. The video shows police drive Hibler away and then check on the kids, asking if any of them have a driver’s license. But then officers leave the scene. Video from the bystander shows the car on the side of the road with the children inside.

Did Hibler have priors, and if so, what were they?

Did the police allow Hibler or did they themselves, call someone Hibler gave a number for to come get the children?

I don't know the answer to the first question, but with the second, it doesn't appear the police did anything to deal with / protect the children.

Yeah it was the police's responsibility to makes sure the kids received care for at least 11 y.o and 1 y.o.

" the article does not state anything about a prior record, though I imagine in the interest of justifying tasing someone over a 2018 warrant for no vehicle insurance, they'd be listing any criminal record to make him look as bad as possible.

Not necessarily. If the article's author wanted to paint the police as monsters, they would leave that detail out mentioning only what he was pulled over for. So, I'd like to see what his whole record looks like.

1. There's two cops who'll not only become unemployed, but criminally charged with endangering minors.
2. The city of Hazelwood will have a major lawsuit filed against it.

Hazelwood Police Chief Hudanick says it is their policy that minors should not be left unattended. The internal investigation will look into use of force from this incident as well as the policy surrounding passengers in the car. First Alert Four is working to learn the status of the offices and additional details of the investigation.

Hibler was released Thursday morning and no charges have been filed surrounding the traffic stop at this time.

A cop pulled her gun on me two years ago for a parking violation as my kids were loading up the truck, when I filed a complaint they refused to address it. I had it on video.

You're the lawyer. Fear of life? Unlawful endangering you and your kids? Reckless use of a firearm? Not all lawsuits involve money. Just the publicity is enough to cause the Mayor or police department to issue an apology, change their procedures and reprimand, if not terminate, the reckless officer.

if you were truly a lawyer and a former prosecutor, you would already know that the courts have stated that there is no constitutional right to NOT have the government point guns at you.

99% of the time, the city settles while claiming that there was no wrongdoing. If, by some miracle, the cop is fired, the union arbitration almost always gets the cop his/her job back, with backpay. That, or the cop finds another job with another agency.
