The Worst Scandal in American Higher Education Isn’t in the Ivy League

The moral collapse at Liberty University in Virginia may well be the most consequential education scandal in the United States, not simply because the details themselves are shocking and appalling, but because Liberty’s misconduct both symbolizes and contributes to the crisis engulfing Christian America.

Liberty is facing the possibility of an “unprecedented” $37.5 million fine from the U.S. Department of Education. The education department has been investigating violations of the Clery Act, a federal statute that requires federally funded colleges and universities to publicly report data about campus crime.

Hardly. This thing between Liberty University and the DOE is mostly about Liberty U not keeping accurate records of crimes and safety incidents on campus. It's hardly the first time the DOE has gone after some university for sloppy records keeping under the Clery Act. Michigan State was smacked down for the same thing ($4.5 million). ASU in Arizona was found in violation in 2020 (worked out a settlement without fine). University of Montana was hit for $1 million for violation. University of Texas San Antonio ($670,000) in 2021.

There's plenty more examples. The egregious thing with the Liberty University case isn't the violation, those are common as anyone can see, but rather the massively excessive fine being asked for by the DOE that's on the order of 10 to 20 times greater than any other university has gotten for doing exactly the same thing. It's pretty damn clear that the DOE is punishing Liberty for political reasons rather than legal ones.

If there's a scandal here, it's the politicization of the Department of Education against conservative universities.

“This is the single most blistering Clery report I have ever read. Ever,” said S. Daniel Carter, a campus safety consultant who reviewed a copy of the initial report obtained by The Post. Earlier in his career, Carter filed Clery Act complaints against multiple universities, including Liberty, as a victims advocate. “I cannot think of a single other comparable case in the entire 32-year history of the Clery Act.”

Crime statistics, too, were systematically underreported, according to the 74-page review, which says Liberty could not provide basic documentation to substantiate its campus crime figures. The authors note that schools that participate in federal financial aid programs are legally required to produce records of this kind.

So? Violations of the Clery Act are common as I demonstrated. The usual remedy it for the DOE to work with the university to remedy the situation and impose a fine. The DOE in this case has made it exceptional rather than done like so many before. The fine, as I showed is grotesquely out of line with ones previously imposed for similar reasons being anything from 10 to 20 times bigger.

As one example I already listed, the ASU (Arizona State University) case was found to be in "serious violation" of the Clery Act, with similar wording to the Liberty U case.

ASU was allowed to work out a deal with the DOE to revamp their reporting system without a fine. The same issue is the case--EXACT SAME ISSUE--with Liberty U, but the DOE doesn't want to give them a chance to fix things and went to a massive fine right off the bat.

The University of Montana, like Liberty U, was found in violation of the Clery Act for nearly a decade. UM got a $1 million fine.

That was considered bordering on excessive.

And, remember, this is about reporting crime and safety violations on campus and has NOTHING to do with prevention or dealing with those, simply reporting. It's a paperwork exercise required by the DOE and federal law.

Okay, where's your facts? Or, are you going to parrot the same repeated article that appeared in the NYT and WaPo, among other Leftist rags virtually word-for-word?
