While they do like blaming others this is really on Alina Habba's incompetence as a lawyer, which is why she is eager now to pretend it was something else.

And this is not the first time. Laura Ingraham called her out on her show prior, when the Trump lawyer failed to join an appeal, on a key issue, that media and others were appealing.

Laura Ingraham asked her basically 'does the Trump team not surrender their right to appeal later, if they do not contest this ruling as others are doing' and Habba just looked genuinely embarrassed and confused and said something like 'I don't think so'.

Because Habba is pretty, Trump will keep her and derps here will try and defend her, and i think that is great. Please keep her. Please give her more duties for Trump and let her file and argue more cases.

No one in NYS gets a jury trial if no one checks that box.

Many people check the box and many end up with Jury trials.

Only derps say 'it is not guaranteed I will get a jury trial, thus i will not check the box and even ask' and then complain when they do not get a jury trial, as they walk to their trial and peek in other court rooms and see all the Jury trials going on BECAUSE THEY CHECKED THE BOX.

But don't get me wrong as i LOVE Trump incompetence, and i love his derps cheering it on. Trump, himself ADMITS he wants a jury trial but does not have his lawyer check the box asking for one as it is not 'guaranteed'.

You cannot make stuff like that up. That level of stupidity to not ask, because it is not guaranteed, and then to complain you did not get one, is just OH SO DELICIOUS!

Hard to say for certain as he does lie constantly.

But even in NYS, you would think he would believe he is better off hoping that just one juror of twelve gets on and hangs the verdict than in hoping this judge will find in his favor, given all prior rulings.

Seems like a monumentally dumb mistake to me, and with Trump that is always the best bet.

The box is checked by default as the trial is assumed to be a Bench Trial unless you "Demand" otherwise.


jury demand: a request for a trial by jury by either party. There are specific procedures for making a jury demand, which include filing a written demand with the clerk and paying a fee. The procedural rules place time restrictions on when a jury demand must be made.

Jury Trials

The jury, not the judge, will make the decision and then a judgment will be entered based on the verdict reached by the jury. Those are mostly tied to the verdict he has already given, and settling on the sanctions and penalties. However on the outstanding counts, still being tried, had Trump's team requested a jury trial, the Judge would have to consider whether to split them out and allow that, or keep the case together.

But again, if you do not ask, there is one thing that is certain and that is you will NOT get a jury trial.
