sep 2 2023 A Texas law requires drunk drivers to pay child support if they cause the death of a parent. The commonsense measure took effect on Friday after being signed by Lone Star State Gov. Greg Abbott earlier this year in June.

"Any time a parent passes is tragic, but a death at the hands of a drunk driver is especially heinous," Abbott tweeted in July. "I was proud to sign HB 393 into law this year to require offenders to pay child support for the children of their victims."

The payments will be required of individuals convicted of intoxication manslaughter involving the death of a child's parent or guardian. The court will consider various factors when deciding the amount of the monthly payments, and the payments will be required until the child turns 18 or graduates from high school, whichever occurs later.

In the event that the guilty party cannot make the payments while incarcerated, he or she will be required to start shelling out the money no later than the first anniversary of the date of release.

"The defendant may enter into a payment plan to address any arrearage that exists on the date of the defendant's release. The defendant must pay all arrearages regardless of whether the restitution payments were scheduled to terminate while the defendant was confined or imprisoned in the correctional facility," the text of the measure states.
 
I wonder if a motor vehicle of some description
touched TDAK in inappropriate places
during his formative years.

As for the texting part,
I admit to hating smart phones myself.
I just don't obsess about it.
 
Article says the courts will decide what the payments should be which means the judges will be bribed . Be better to fix it at one number, say $500 a month.
 
I am certainly not here to defend drunk drivers.

But, what if the drunk driver killed a child in the accident? It seems this law, falls short, by only addressing the restitution or reparations for the deaths of parents. I mean, if we are to tack on additional punishments for drunk drivers that kill parents, WHY NOT TACK ON EXTRA PUNISHMENTS WHEN DRUNK DRIVERS ACTUALLY KILL CHILDREN IN CAR CRASHES?

What about when a reckless driver causes a car crash and kills an innocent parent? Why does this have to do with drunk drivers only?

What about murdering parents, where an automobile was not the weapon of choice, but perhaps a gun was used instead? Why should they get a free pass from having to pay child support. I mean these were not deaths by accident but intentional murders.

What about when a parent dies of an overdose, should his dealer pay child support?

If your answer is reparations or restitution for these kind of deaths are best handled by filing Civil Law Suits, why can't civil lawsuits also be the answer for drunk drivers killing a parent in an accident?

I think these are good questions for Greg Abbott to have to answer!

I think the law presents double standards and slippery loopholes, and is not very well thought out!

for decades drunk drivers have been killing parents and nobody in government gave a fuck about what happens to the kids, but kill a cop while drunk and now all of a sudden government must do something to help provide for the children..................

that's how/why this law came about after some drunk idiot killed an off duty cop while driving

OK - but this is still a good law even if you don't like why it was passed.
