The only flaw in your theory is that Biden ALREADY beat Trump.

But if Biden is the Democrat candidate in 2024, can he do it again? I doubt it given his poll numbers. It'll likely be a close election if Biden and Trump are the candidates, but Biden has a track record as president now, as does Trump, and Biden's record with roughly 2 out of 3 people is one of being shit as president.
 
We have sunk to a new low when public opinion decides whether a person should be investigated and charged with crimes.

That same poll found a majority of voters do not want Biden or Trump to run again.

Additionally, the poll found that 57 percent of registered voters believe that Trump will be acquitted. The survey found that 55 percent of Americans say Trump’s indictment is politically motivated, including 83 percent of Republicans and 55 percent of Independents. You realize grand juries only see what prosecutors allow them to see, dont you Perry Mason?

A grand jury is empaneled to determine whether enough evidence exists to move forward with an indictment.

A grand jury determines whether there is “probable cause” to believe the individual has committed a crime and should be put on trial.

A grand jury does not determine guilt or innocence, that is why the defense isn't allowed to speak.

The grand jury in this case listened to the evidence and determined there was indeed enough to move forward.

The defense will get their turn at the trial.
