INDIANAPOLIS (AP) — A suburban Indianapolis Army veteran was sentenced to 55 years in prison Wednesday for the road rage shooting death of a Muslim man after witnesses said he hurled ethnic and religious insults at the victim.

Dustin Passarelli of Plainfield was convicted in May of murder and a felony firearm enhancement in the February 2019 shooting death of 32-year-old Mustafa Ayoubi.

Passarelli followed Ayoubi off Interstate 465, and a verbal altercation took place, prosecutors said. Witnesses said Passarelli made several Islamophobic remarks, including “Go back to your country," and used hate speech before opening fire.

Passarelli told police that Ayoubi either threw something at his car or collided with it on the highway and that after he followed Ayoubi to an apartment complex, Ayoubi broke one of Passarelli's car windows with a punch.

The defense argued that Passarelli was within his rights to fire at Ayoubi because it was self-defense.

You confuse worship with respect, at least in my case. I respect people who defend this nation against enemies both foreign and domestic. There are a few bad apples, but most are just men and women doing a service to their country.

There is no hero worship of the military, just political lip-service. Notice how many members of Congress haven't served. If there was hero worship, then we'd be electing more vets instead of reality TV show hosts, businessmen and lawyers.

Have you ever been close to anyone who served? Most Americans haven't. Where did you get the idea of "hero worship", Tink?

It wasn't PTSD. The Military Times link doesn't detail his service record. I doubt he did more than a hitch. Probably just watching too much Fox News and associating with racist fuckwits at the bar.

Passarelli claimed that post-traumatic stress disorder he developed during his time in the Army contributed to his behavior on the highway and was partially to blame for the shooting. But Passarelli’s mental evaluation and PTSD claims were ruled inadmissible in court.

Prosecutors argued that Ayoubi’s car had no collision marks and his hands and arms did not have injuries to support claims that he had punched out a car window, and they argued that Passarelli had instigated the confrontation.

"He had a choice to leave," said deputy prosecutor Janna Skelton, "and he stayed."
