It already has been decided in court so there is precedence.

Judge Jackson added that “the PRA contains no provision obligating or even permitting the Archivist to assume control over records that the President ‘categorized’ and ‘filed separately’ as personal records. At the conclusion of the President’s term, the Archivist only ‘assumes responsibility for the Presidential records.’ . . . PRA does not confer any mandatory or even discretionary authority on the Archivist to classify records. Under the statute, this responsibility is left solely to the President.”

Biden was merely negligent, as was Pence. Trump was "screw you". But even though Trump took national security documents, which Biden did not, and openly stored them in his much visited resort he would not have been arrested either if, like Biden and Pence, he had promptly returned them. Instead he lied and tried to keep them while continuing to expose them. Even you can see the difference if you let yourself.

I disagree.......there was the Eisenhower presidency, several good years from pre-Watergate Nixon.........we had the Reagan presidency........and three fantastic non-Covid years under Trump.......no other presidencies come close.....

- "Establishes that Presidential records automatically transfer into the legal custody of the Archivist as soon as the President leaves office."


And if the POTUS then argues some of the material is personal and not PRA document, the Archive will consider it and return the item to the ex POTUS if they agree.

Yes he has years to make that argument while the Archives holds on to the documents. The key part is that an Ex Potus must IMMEDIATELY give everything over to the Archivist, and then he can argue for what he claims is personal property and if correct the archivist returns it.

And whether it is an original or a copy, they are all still classified.

When the Gang of 8 are all given Top secret documents to review, they are given copies. They cannot take those outside the SCIF or home or give to the media saying 'they are copies and not originals' as it makes no difference.

He never says that till he was caught. He admits in an audio recording that he didn’t declassify them. He also did not complete the process to declassify them. There are governmental procedures that need to be followed. Some of the documents were so top secret that even the President can’t declassify them. He will be convicted by his own words and actions to hide the documents.

Doesn’t matter what he says it matters what the law says and there is no law dictating how to declassify documents

There can be a process but that is really just a courtesy and that is why this case will be dismissed outright

The archives already had every single document Trump had so he didn’t hide anything from them
