Kash Patel: All The Documents At Mar-a-Lago Were Already Declassified

Former Trump national security staffer Kash Patel called in with Martha Maccallum on FOX News on Friday to react to the release of the warrant used by the FBI to search President Trump's Mar-a-Lago resort home.

"If he says something is declassified, that's it, it is declassified," Patel explained. "He declassified a whole set of documents that should have come out... That's on the National Archives to sort that material out... Even if it was classified, they'll never meet the burden of intent because the president didn't pack it up and take it out himself, the G.S.A. has said they did it and they made a mistake."

All any President needs to do is say, these documents are declassified. End of story... period. The President doesn’t need to write it down, he doesn’t even need to tell anyone. If the President says it’s declassified... move on, no story here. There are no clear procedures for the President to Declassify anything.

Apparently not

Trump was just indicted on seven counts of mishandling national security documents, conspiracy, obstruction of justice, and making false statements.

Trumps lawyers say he is also charged with violation of The Espionage Act.

Some of the charges against Trump include making false statements, conspiracy to obstruct and willfully retaining documents in violation of the Espionage Act, sources confirmed to NBC News on Thursday.

Total horseshit. If trump really had that power, why try to hide the documents and why lie about returning them? No one buys that trump can "declassify documents by thinking about them" - no one but mindless nazi trumptards.

The sad little dupes on the left and liars in the media and the DNC are never concerned about basic facts. ;)

Special prosecutor Jack Smith knows so much more than a mercenary like Patel. Smith would not indict anyone, especially a former president if he didn't actually commit a crime.

Yet somehow he left out the part where there are regulations that specify exactly how this is to be done. There's a paper trail and there is documentation declaring that information declassified. It has to be signed off on by multiple people. All #TRE45ON had to do when the govt. requested the return of the material is give it back, tell them that he declassified it, and here's the proof.

That magic wand that you Trumptards think he's got? It's not a wand. It's a toadstool. :rofl2:

“There doesn’t have to be a process, as I understand it,” Trump said. “You’re the president of the United States, you can declassify just by saying it’s declassified, even by thinking about it.”

He knows better. he was informed of how to, classify and declassify and the procedures he needed to follow. I am pretty sure they did not tell him he could abracadabra classification whenever he felt like it. That means every single dept would have to contact him to see if it was using classified paperwork. But if he said it was classified, how do they know he would not abracadabra it back after lunch? In short, that argument makes no sense at all.

His cult is stupid and gullible enough to believe this. Just look at pEarl, for instance, who *still* insists that this is not a falsehood. Wonder how many of the dupes have sent him money since the news broke.

The fact that he's on tape waving around one of the classified documents and saying he wished he could show it to everyone tells us that he knew it was not declassified. Couple that with the fact that he deliberately refused to return government property. He's so hosed. Good.

Here's a tip. If Kash Patel goes into private practice and you seriously need a lawyer and your friend recommends Kash Patel, don't take your friend's advice.

Fox News, that says it all.

Kash Patel is likely to be indicted and lose his law license.

Even Trump does not believe that. Nor did any one in his White House administration.

During Trumps term as POTUS, he made statements (oral or written(Twitter)) 3 times that he had declassified info in his usual impetuous way.

In all 3 instances the Media said 'Good', and then sent in FOIA requests to get the declassified info, as then is there right.

In all 3 instances Trump and his WH staff then thought 'Oops, we don't want them to have that' and they voluntarily went in to court, sent by Trump, to argue that Trump simply making statements (oral or written (Twitter)) DOES NOT actually declassify shit unless the secondary steps are followed thru to actually declassify them.

It is 3 of the rare times Trump and his team actually won in court with the Courts finding all 3 times that statements alone that something is declassified by Trump ARE NOT enough, and the Media lost all three cases.

- James Madison Project v. U.S. Dep't of Justice
- LEOPOLD et al v. U.S. DEPARTMENT OF JUSTICE et al, No. 1:2019cv01278 - Document 86 (D.D.C. 2020)
- The New York Times, et al., v. Central Intelligence Agency

So the argument now that Trump can declassify with his mind or a statement is just laughably dumb considering Trump sent Mark Meadows into court and he won arguing that 'Trump statements alone with no follow up, do not declassify shit'
