“He didn’t enter the subway seeking to harm anyone. He didn’t attack anyone,” Kenniff said of Penny. “He was really putting himself in harm’s way for the benefit of others. He shouldn’t be pilloried for that. He should be celebrated,” Kenniff told hosts John Catsimatidis and Rita Cosby. Penny placed Neely into a deadly chokehold aboard an uptown F train on May 1 after the homeless man was observed “making threats and scaring passengers,” prosecutors said. “The reality is that there is not a single living, breathing New Yorker — particularly anyone who rides the subways — who can’t relate to exactly the sort of situation that my client and the other passengers on the train were confronted with,” Kenniff said in Friday’s radio interview. “In no way shape or form [did Penny] seek to demean the victim in this case,” he added.

Kenniff told the hosts his team is conducting a “very active investigation” that he said will absolve Penny of the charges against him.

“My firm works with all retired NYPD detectives, some of the best the business,” Kenniff said.

“We’ve uncovered a lot, and I think there’ll be a lot more to come, quite frankly.”

Penny surrendered to police in Manhattan Friday morning and was arraigned soon after.

He was released after posting $100,000 bail.

The thug had been arrested more than 40 times.

If there was a liberal on that subway train and he/she could be forced to tell the truth, you would hear, "thank you for shielding us from harm from this thug who was telling us that he was going to kill us.

They should hire more like penny and put them on the subway.
 
One thing's for sure. This will have a chilling effect on people riding the subway doing anything to stop crazy, potentially dangerous people on it from doing acts of violence against other riders. Instead, if they act at all, they'll wait until the violence is underway or done to stop the criminal and one or more people who were innocent will now have their life destroyed because the city defends the so-called rights of the mentally ill to act out in violent ways in public.

I’d side with the guy, as apparently does Mayor Adams, but you still have to recognize the questions involved, a guy was killed, and if you ever rode the subways, which I am sure you never have, these people don’t scare others, most just ignore them recognizing their situations and their idle threats

And before you go there, from MAGA posters yesterday no less, 27 people were murdered in NYC over the course of the last three years, which considering close to three million people a day ride the subway, would mathematically make the NYC subway one of the safest places in America

Stretching those numbers a bit. The daily ridership ranges between 2.37 million to 1.64 million and it isn't like they are spending 24 hours in the subway like a person in a town would spend in a town. The average ride is 32 minutes so divide your number ~48 and you would have a town of 62,500 spending 24hrs 7 days a week in the subway. And how many people are violently assaulted on the subway.

There were 461 felonious assaults, eight murders and eight rapes in the city's subway system last year, which all rose from 2020 levels
For a continuous ridership of the size of town of 62,500. So no the subway isn't one of the safest places in America. :laugh:

No, crazy people will not pay attention to this case. They are by definition crazy, and you think this murder matters to them? This is why defunding the police will work. They will use part of the cop's budget to hire psychologists to work with the police to defuse the mentally ill. Your idea. just kill them.

These violent thugs who have been arrested 40 plus times and attack women and threaten innocent passengers should be segregated from society.

Many of these mentally ill people have chosen to abuse drugs and alcohol…which cause them to become mentally ill.

Look who the left prefers to punish. The brave Marine veteran who stopped the thug from assaulting the passengers.
