That might have made sense if it was a criminal trial, where he needs to be proven beyond a reasonable doubt guilty... This is a civil trial. They just need a preponderance of the evidence (51%). Ten witnesses against NOTHING is a preponderance. Realizing he made a huge mistake, he announces he is rushing back to the USA to testify... But also realizing his deposition was the strongest evidence against him, he knows testifying would be a bigger mistake.
