charges are quite appropriate. it's a tragedy all around. i'm glad the kid survived. I hope he gets some counseling for this. It's terrible that an elderly man now will have to spend what little of his life is left in prison.

If only we could hold cops this accountable.

there is common sense. it's a recognition that the state has to PROVE a crime was committed, not gets to automatically assume one was just because a gun was involved.

Yep, you never fire without absolute knowledge of your target. The old man is a fool.

That said - a knock on the door at 2:00 AM is likely to startle most people. That's no excuse for him though - firing at people outside your home who are not posing an eminent threat will rightly land you in prison.
