Dominion defamation trial against Fox to proceed Tuesday after delay

WILMINGTON, Del, April 17 (Reuters) - The trial in the $1.6 billion defamation lawsuit by Dominion Voting Systems against Fox Corp (FOXA.O) and Fox News will proceed with jury selection resuming on Tuesday rather than on Monday as previously scheduled, a judge said on Monday.

Delaware Superior Court Judge Eric Davis did not provide a reason for the delay in the trial, stemming from Fox's airing of false claims that the Denver-based company's machines were used to rig the 2020 U.S. presidential election in favor of Democrat Joe Biden over Republican-then President Donald Trump.

Looks like FOX made a cheap offer to settle and Dominion rejected it.

Dominion should not settle. That's a selfish viewpoint, but if they do, Fox just keeps getting away with it. I think Dominion believes they have an incredibly strong case. I agree. At least one element necessary is already settled. And proving that Fox new those statements were false is obvious as well. The question is whether it rises to the level of reckless disregard. Fox is in a world of hurt. This may end them.

I'll bet this is a plot twist 'Succession' never saw coming.

To win you only need to show FOX knowingly presented false information. And we already know they admitted it.

The standard is higher. But still easily provable. Absence of malice would get Fox off the hook. This isn't a standard defamation case. If it was, there would have almost certainly been a summary judgement for Dominion.

I don't think you have to prove malice, no. Dominion is arguing they lost sales and future revenue.

Malice just means deliberate lying.

Yep, it's a special circumstance for 'news' organizations. But I agree, it is very close to a slam dunk. I doubt Dominion would ever settle without a full admission from Fox, and Fox really can't do that.
