You should pay better attention to what I said. Unless their case is 100% slam dunk solid, and it isn't a summary judgement won't happen. They may well have a good case, but it will have to go to trail. No sane judge would rule in Dominion's favor summarily over a 1.6 Billion dollar outcome.

You see, the burden of proof rises for the party requesting summary judgement, so either you got a lock, or you got nothing. My bet is Dominion has nothing and wants to avoid the cost of a trial along with the possibility they'll have to produce all sorts of evidence about how they program their voting machines.

Dominion filed a motion for summary judgement in their defamation lawsuit against Fox News. A major part of that pleading was the presentation of evidence that Fox and it's anchors KNEW that claims being made against Dominion were false. That evidence included internal communications regarding the coverage of the 2020 election, and the false claims that Joe Biden stole the election from Donald Trump.

Tucker Carlson: “Sidney Powell is lying by the way. I caught her. It’s insane.”
Laura Ingraham: “Sidney is a complete nut. No one will work with her. Ditto with Rudy [Giuliani].”
Tucker Carlson: "[Trump] is a demonic force, a destroyer...”

Just one of many explosive quotes in the pleading, which, among other things, established that Fox News held ratings and stock prices above telling the truth. Despite acknowledgment of this, Fox from Murdoch on down CHOSE to lie to their viewers because the stock price was suffering when they told the truth.

Trump voters, they laughed at how stupid you are, acknowledged that they were spoon feeding you lies, and yet you came back to say 'can I have another, sir?'

There are no claims from Fox that anything in the pleading was false or misleading. They are not disputing this.

Will you tune in next week to watch Carlson lie to you? Or have you finally figured out what Fox is all about.

I'm not a lawyer, but I do at least understand the basics. A motion for summary judgement is a pleading that basically argues that there are no material facts in dispute. The only question is whether that set of undisputed facts supports a judgement for one of the parties, in this case, the plaintiff. Fox appears to be screwed. They are now making claims about context, but those are likely to fall on deaf ears. Summary judgement is hard to win, and it probably won't happen here, but Dominion filed because they believe there is no issue to be decided. They believe their case is that strong.

Suggesting they are doing this because they know they have no case is so absolutely dumb that it hardly deserves a response. If that was the case, Dominion would simply drop the suit. Good grief, is it really that hard to understand? I guess so.
