Thomas Jefferson was making a philosophical statement in that Declaration

Equality, liberty, and the pursuit of happiness are Nature's law or God's law, which exist independently of man's law, exists independently of the opinions of kings, monarchs, or the popular will.

That is to say that natural law exists by virtue of us simply being human, regardless if the civil authorities, government, or popular opinion act on it or acknowledge it.

The Declaration, incidentally, was drafted by Jefferson, edited by others and signed by all thirteen colonies except one through their representatives at the Second Continental Congress. The idea of equality was later
enshrined in the Constitution, meaning all persons are equal under law, or are supposed to be.
