That is what happens when politics get involved. They were never going to prosecute him no matter what the evidence show. Law officers know the shooting violates protocol and was not justified.

Trump has several speakers who preceded him urged violence. That was as Trump planned. Then Trump told the big lie. "we won the election in a landslide.' He also says it was stolen from them. Trump said we will never concede when there is theft involved. We will not take it anymore. If you do not fight like hell, then you will not have a country anymore.
Then as lawyers must have told him, he said to go peacefully and politically to make your voice heard. That was a dead message because he and other speakers spent hours riling them up in anger and urging violence. He was making an addon to protect himself. They all knew the message. But Trump wanted to save himself. Your rightys were already primed to go, and fired up as hell.
