Historian's fallacy.

Lee, like many other officers from Southern states put their state ahead of the federal government. At the time--not by modern standards--that's how most Americans saw things: My state comes first, the nation comes second. Lee, and others like him resigned their commissions as required by law and then were commissioned by their state to lead troops primarily from their state.
