Bloomberg) -- The Biden administration urged the US Supreme Court to clear the release of former President Donald Trump’s tax returns to a House committee, saying the justices shouldn’t second-guess lawmakers’ motives for seeking the documents.
The House Ways and Means Committee is on the brink of getting six years of Trump’s returns, with only the high court standing in the way. Chief Justice John Roberts temporarily blocked the Internal Revenue Service from transferring the documents while the court considers Trump’s request for a longer delay.
The committee is racing the clock to obtain the records, given the possibility that Republicans will take control of the House in January after the midterm election results are finalized. Trump says the panel lacks a legitimate legislative purpose and the real goal is to make the documents public for political reasons.
In her filing Thursday, US Solicitor General Elizabeth Prelogar argued that “time and again, this court has rejected attempts to invalidate otherwise appropriate legislative requests based on evidence of additional motives.”
Prelogar, the administration’s top Supreme Court lawyer, filed the brief on behalf of the Treasury Department and Internal Revenue Service.
The committee says it needs the returns to consider future legislation on issues including presidential compliance with tax rules, public accountability and mandatory IRS audit policy for presidents.
