It had been subpoenaed. That is a very forceful asking. trump refused to hand it over, even though he was legally required to. Even when they served the warrant, he could have just given them the combination to the safe. At every point, trump could have cooperated, but did not.
Obama's records are being stored in a NARA controlled facility in Chicago. Obama does not have control over the facility. They are being held there as it is worked out what records will be made public through the Obama Presidential Library. Even when in the Obama Presidential Library, they will still be owned by the US Government.
There has been lengthy negotiations in the case of Obama. Everything has been done 100% legally. Obama is not storing stuff in his bedroom closet, or offering to sell it on the blackmarket.
