The evidence is clear Trump (and others in his circle) broke the following two criminal statutes.


18 USC Sec. 1512
(c)Whoever corruptly—
(1)alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or
(2)otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so,
mshall be fined under this title or imprisoned not more than 20 years, or both.


18 USC Sec. 371
If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons
do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.

If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such
misdemeanor.


The question becomes... Should he be prosecuted?

Lots of obstruction on the part of the former president, it is not unusual for big investigations at the justice department to take a long time to get to the top. Compared to some other investigations this one is relatively short so far.

Agree with after November. Garland won't be stopped by who Trump is but it would be proper to avoid the possibility of influencing an election where Trump is not a candidate.
