Read this part again.You seem to have missed the last part of Section 8 where it says - To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.
Nobody is being treated differently.What you are proposing is that they can treat them differently.
This is not happening.It is being violated the minute a married couple's rights are being treated differently in one state compared to another.
