oh, and privacy has nothing to do with it. that was the mistake.

States are free to write laws pertaining to abortion because they have the power to make criminal/civil laws. They couldn't write those laws during Roe v. Wade because a law prohibiting abortion before 24 weeks was unconstitutional. That is no longer an issue.

The 10th Amendment does not allow a state to make laws that violate the Constitution.
