Judge Acquits January 6 Defendant: ‘Reasonably Believed’ Capitol Police Let Him In

I couldn't BEGIN to give a shit what ANY house committee says about ANYTHING - on either side.

When Trump is charged and convicted in COURT...then and ONLY then will I believe the Great Manchild did whatever the left is freaking out about over January 6.

Not one second before.

If you honestly think that Congress is a useful tool for getting to the truth?
You are a lot more politically gullible than I gave you credit for.
No offense.

Good day.
I believe the evidence. A judge has stated he thinks there was conspiracy after viewing the evidence.

I do not care what you think of me, no offense.

its okay to believe the evidence......but you've never seen any........you just believe in a judge.......you don't really know if he's seen any either....

Bad decision. It will be overturned.
I don't believe an acquittal can be overturned.

People like this guy who simply wandered in to gawk are very different than the snarling, drooling MAGAS who committed violence and property damage.

While I was watching it on t.v., I kept worrying that some of the morons would destroy the centuries old paintings that hung in the rotunda.

"McFadden described Martin’s testimony as “largely credible.” The judge said it was not unreasonable for him to believe that officers allowed him to enter the Capitol, even though alarms were blaring and broken glass was strewn about the floor."

This judge is incompetent. Like saying rioters broke down the front door and glass of a store so it is ok to go in and steal stuff.
If Martin tried to leave with a lectern, then he would have been guilty of a crime.

I'm sure there is video of a cop simply waving him in at some point.

I agree, I think this was the right verdict. We have to remember that a lot of Trumpublicans are simple minded sheep. It sounds like this is the case here.

is 'Hate' a mental illness?

are you projecting again? throughout this entire forum we've seen the dozens of examples of your hate...........can you post any of mine/

If that was true, you'd be able to quote three juicy ones. I can always tell when you are lying when you answer a question with a question. The "we" is another clue.

I asked you a question about who you hate.....and you ran from it. Okay. Your choice.

I understand your need to lie and deflect. i'll save you the embarrassment.

Translation: I can't back up my own words. I just act tough online and recruit younger idiots militiamen.

Awesome. Old oath-breaking cowards need a hobby.

Are you seriously claiming you were at the Capitol on 1/6, Matt? Any photos?

Why would I be there? It was supposed to be a peaceful rally. Only STY and a few other terrorist supporters knew something else would happen that day.

Oh, I've been to the Capitol, just not on 1/6. :)

Or in the year 2000-anything.

I'm certain there will be a few more of these. I watched a video where the cops were holding the door open and waving folks in.

Hello ziggy,

On Wednesday, a federal judge acquitted a January 6 defendant on all charges after ruling that the New Mexico man “reasonably believed” he was allowed to enter the Capitol building during the protest against the 2020 election results after being let in by United States Capitol Police officers.

Judge Trevor McFadden “issued the verdict from the bench after hearing testimony without a jury in the case against Matthew Martin,” The Washington Post reported.

Martin was the first January 6 defendant to testify in his defense trial and argued that Capitol Police allowed him to enter the facility. According to the Post, Martin “said he ‘went with the flow’ as he approached the Capitol and testified that he saw a police officer wave him into the building.”

He was in the Capitol building for roughly 10 minutes on that day.

The Post reported:

Martin was charged with four misdemeanor counts: entering and remaining in a restricted building, disorderly and disruptive conduct in a restricted building, violent entry and disorderly conduct in a Capitol building and parading, demonstrating or picketing in a Capitol building.

Buzzfeed provided more details behind McFadden’s verdict:

Announcing his decision from the bench, US District Judge Trevor McFadden said that although prosecutors argued there were numerous instances when Martin would have been aware that he wasn’t allowed on Capitol grounds or inside the building — as he walked past fences with signs saying “AREA CLOSED” and recorded video of a broken window, blaring alarms, police in riot gear, and people who appeared to have encountered tear gas — those were outweighed by Martin’s “plausible” belief that he had permission because officers didn’t try to stop him from entering.

McFadden said that Martin’s conduct was as “minimal and non-serious”as the judge could imagine for someone who went into the Capitol on Jan. 6. He said that Martin seemed to be a “silent observer” of the scene and didn’t try to crowd the police, protest, or wave the “Trump” flag that he was carrying. Martin appeared “quiet” and “orderly” as he walked inside the building, filmed video inside the Rotunda similar to how the media would behave, and didn’t appear to interfere with officers as he filmed a clash with rioters later in the afternoon on a north terrace of the building.

According to The Post, “More than 770 people have been charged with riot-related federal crimes. Over 240 of them have pleaded guilty, mostly to misdemeanors, and over 140 of them have been sentenced.”

As noted by Buzzfeed, the verdict “represented an early test of efforts by some Jan. 6 defendants to argue that police allowed them to enter the Capitol, or that they believed they had permission because no officer told them to stop.”

Trumper judge.

The defendant clearly violated the law.
