He's not in favor of legalization, he just doesn't like the way it's made illegal.

His whole line of reasoning, in other words, is not about wanting marijuana to be legalized. It’s not even necessarily about ending federal marijuana prohibitions. It's a part of Thomas’s larger belief in which he wants to limit the areas where federal legislation is authorized.

In particular, he doesn't like the way the commerce clause is being applied.

He believes that the Supreme Court’s rulings on the Commerce Clause have gone too far, allowing Congress to pass all kinds of questionable legislation and it “has encouraged the Federal Government to persist in its view that the Commerce Clause has virtually no limits.”

So IOW, he's just found another way to march in lock-step with the far right who hates regulations on anything, including guns and environmental polluters.

Fuck him.

The 2nd was based on not having a standing army. It was a way to quickly raise an army to defend the USA if needed. Technology has changed. A standing army is necessary and we have one. Arms have become far more lethal. The right to keep and bear them should be heavily regulated. Certain arms should be off limits to the general public. We actually already do that. Truth of the matter is that no one knows what the Second Amendment is based upon, the operative clause which gun lobbyist center upon is irrelevant until one can define what the prefatory clause means, which no one has been able to do in over two hundred years.

Scalia's sophomoric "originalism" theory is bogus, and just a fabrication for him to justify ignoring the prefatory clause
 
Does it really make a difference if Thomas is physically present on the Supreme Court, he has next to zero presence, seldom if ever gets involved in arguments, and largely just votes the way his wife tells him to vote. What he does can be phoned in from anywhere
