Two separate motions independent of each other. In addition it is very unlikely the judge will grant the motion with prejudice. I would be shocked. You don’t seem to understand the variables. If you think you are winning a trial, you don’t want to start over and do it a second time No matter what mistake the prosecution may have made.

The judge is far more likely to understand the nuance of the law. Was he provoking? While the SCOTUS has ruled multiple times that having a gun is not provocation, some jurists are likely to ignore that nuance and think that just by being there he provoked the attack, for instance.
