Yes, she was climbing through a window. That isn't a violent act or one that threatened anyone on the other side with serious bodily harm. The correct response for an officer would have been to approach her, get her attention (gun drawn is fine having it in high or low ready and obvious), issue verbal commands to either back up through the window and stop advancing, for her to get on the floor on her knees, or the like. If she refused to follow such commands, point the weapon at her and repeat them.
There were no, ZERO, none, nada, zip-point-shit, members of Congress anywhere near Babbitt at the time. There were none in sight. Babbitt wasn't armed nor was she shouting anything that might give a clue to her intentions. She was shot in the back in obvious and direct violation of federal use of force rules.
THAT follows federal use of force rules. None of that happened because the officer was an idiot who didn't know how to do his job correctly and he murdered a woman for no reason. He should be tried for that idiocy.
